Section 44. Periods of Temporary Stay in Estonia

(1) An alien may stay in Estonia under the conditions specified in the visa.

(2) A citizen of a foreign state with which a visa-free travel agreement has been concluded or in respect of which there is a waiver of visa requirements may stay in the Schengen Convention member states, including Estonia, for up to 90 calendar days during any period of 180 days, unless otherwise provided by an international agreement.

(3) On the basis of a residence permit or a long-term visa issued by the competent authority of a Member State of the Schengen Convention, one may stay in Estonia for up to 90 calendar days within 180 days.

(3.1) On the basis of a residence permit issued to an employee transferred within an enterprise by the competent authority of another Member State of the European Union, it is possible to stay in Estonia for the purpose of transfer within the enterprise during the period of validity of such a residence permit.

(3.2) On the basis of a long-term visa or a residence permit issued by the competent authority of a Member State of the European Union referred to in point 10 of subsection 1 of section 43 of this Act, one may stay in Estonia for the purpose of studies for up to 360 days if an alien is accepted for undergraduate studies or for studies in applied higher education, for undergraduate and graduate studies in integrated curricula, or for master's or doctoral studies.

(3.3) On the basis of a long-term visa or residence permit issued by the competent authority of a Member State of the European Union referred to in clause 10 of subsection 1 of section 43 of this Act, one may stay in Estonia for the purpose of engaging in scientific activities during the period of validity of such visa or residence permit if the foreigner's short-term employment is registered with the Police and Border Guard Board.

(3.4) If, under the conditions specified in subsection 33 of this section, an alien residing in Estonia has been issued a long-stay visa or residence permit by the competent authority of a Member State of the European Union, a member of his family may temporarily stay in Estonia during the period of validity of this visa or residence permit.

(4) An alien who is a member of the ship's crew may be admitted to Estonia as a transit passenger if the purpose of entry into Estonia is to start or end work as a member of the ship's crew on a ship in an Estonian port, to start work on another ship in an Estonian port, and in cases stipulated by international treaties, transfer to a ship in another state, or return to the country of origin.
